    1. These terms and conditions of use (Terms) explain how you may use this website and any of its content (Site). These Terms apply between BS Portal Limited (we, us or our) and you, the person accessing or using the Site (you or your).
       
    2. You should read these Terms carefully before using the Site. By using the Site or otherwise indicating your consent, you agree to be bound by these Terms. If you do not agree with any of these Terms, you should stop using the Site immediately.
       
    3. We provide certain services through our Site which facilitate the introduction of potential students (and their parents or legal guardians) and UK based schools as well as providing a portal through which potential students (and their parents or legal guardians) may apply for school places directly to schools or a school’s authorised third party or agent. We also allow users of our Site to contact one another through our Site and allow potential students, parents and legal guardians, and schools and their agents to communicate with one another directly, or via public forum accessible by other account holders on our Site (the Services).

  3. Changes to our Site
    1. We may update our site from time to time and may change the content at any time. However, please note that any of the content on our site may be out of date at any given time, and we are under no obligation to update it. We do not guarantee that our site, or any content on it, will be free from errors or omissions.
       
  4. Using our Site
    1. General access to our site is made available free of charge. Individuals (i.e. prospective students and/or their parents or legal guardians) may register for a personal account with us in order that they can access our Services. Such an account is free of charge. Any personal data you submit when setting up and using your account will be handled in accordance with our Privacy Policy. We charge businesses and other organizations to access premium features via an annual subscription. ('Paid Subscription'). Terms and conditions are provided to any business or organization as part of their registration process for a Paid Subscription. 
       
    2. Our service allows you to input, store, or share your Content or comment, or receive Content or comment from other users. Content includes, but is not limited to, any personal data or other information you input into the portal or upload in any form (including but not limited to, communication with other users, leaving comments, and submitting applications) or any other information you supply to us though in connection with your British School Portal account.
       
    3. Each account holder shall own and be responsible for all the Content they input, store, or share. When you share Content with other users, both directly or publicly, you understand that they may be able to use, save, record, reproduce, broadcast, transmit, share and display your Content without consideration or compensation. Since you are responsible for all of your content, your content must not violate any law or rights of others. We have the right to disable and record any content, review, comment, or material that is violent, abusive, or otherwise inappropriate to other users and ourselves. We reserve the right to suspend or to terminate our service with anyone who fails to abide by these standards. To that end, all data of that user may be recorded for monitoring and investigation purposes.
       
    4. We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. We strive to keep our service up and running at all times, however, online Services may suffer occasional disruptions and outages. We are not liable for any disruption or loss you may suffer as a result. We recommend that you back-up regularly your Content and other material you have uploaded.
       
    5. Certain content on our Site contains public sector information licensed under the Open Government Licence v3.0.   All the content and data of education institutions in the UK you will find on the British School Portal are directly extracted from GOV.UK (www.gov.uk/school-performance-tables) unless otherwise specified. Although we continually keep these content and data up-to-date, we cannot guarantee an error may occur that caused the unexpected result. We strongly advise users to contact each educational institution if they doubt any content or data displayed on our Site. You may also report to us if you spot an error in any content or data.   You will find links to different third parties on this Site opened with a separate page of the browser. These links will refer you to view the most accurate information provided by those third parties. We take no responsibility for anything outside of our Site.
       
    6. We may receive notifications informing us of the Services you have used. Other users of our platform may also be able to see what Services you have used. Depending on what type of contact data you have shared (e.g. email, telephone number, or mailing address) we or other users (with your consent) may communicate with you via these channels in connection with the Services (e.g. to verify your identity before registering your contact number). Please note that data or messaging rates may apply from your telephone or broadband provider when you receive these notifications subject to your terms with such a provider.  
       
    7. Access to our site is permitted on a temporary basis. We may suspend, withdraw, discontinue, or change all or any part of our site without notice. We will not be liable to you if for any reason our site is unavailable at any time or for any period. You are responsible for making all arrangements necessary for you to have access to our site and you may only use our site for lawful purposes. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these Terms and other applicable terms and conditions and that they comply with them.
       
  5. Setting up an account and support
    1. You will need to create a British School Portal account to use our Services. After creating and logging into your account, you are able to enjoy the service provided by us and contact and connect with other account holders/users. 
       
    2. If you choose, or you are provided with, a code, password, or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms. If you know or suspect that anyone other than you has obtained your user identification code or password, please notify us at  enquiry@britishschoolportal.co.uk.
       
    3. Individuals can create a personal account through our Site base. Schools or other organizations (e.g. agents of schools and other academic institutions) may create a paid-for school or agent account, subject to agreeing to additional terms and conditions available through the relevant account creation page. 
       
    4. In creating a British School Portal account, all users agree only to use true and accurate information when signing up for any type of account. If you have appointed a third-party agent to set up your  British School Portal account that third party may have additional rights over your British School Portal account. We cannot accept any liability or responsibility for any action or conduct undertaken by such a third party. 
       
    5. All British School Portal accounts are not transferable. You should respond to keep your account details and password safe. 
       
    6. If we reasonably suspect that your British School Portal account is being used by a third party fraudulently, we may suspend your account and your content may be disabled until it can be ascertained if such use has been fraudulent. 
       
    7. You may close your account at any time for any reason. You can close your account by contacting us at enquiry@britishschoolportal.co.uk. Once you're applied to close your account, we will suspend your account for 90 days after which your account will be deleted. During that 90 day period, you will be able to change your mind re-activate your account by contacting us at  enquiry@britishschoolportal.co.uk.
       
    8. If your account is suspended, you will not be able to log-in to your account and will not be able to use any of our services provided. 
       
    9. If your account is closed, your right to access your account and your right to use our service will be stopped immediately. All the data, licenses, Content, and other material will be deleted. We will not save or keep this data unless we are required by law to keep it, return it, or transfer it to you or a third party identified by you.
       
  6. Your Privacy
    1. Your privacy is important. We collect data from you. Please refer to our Privacy Policy for more details on how we collect, use, and share your data and how you can control your data.
       
  7. Code of Conduct
    1. When you use our service, you agree to follow our Code of Conduct as set out below:
      Users of our Site, portal and other Services shall not when using our Services:
      • undertake any illicit or illegal activity;
      • engage in any activity that exploits, harms, or threatens to harm any person in any way;
      • provide misleading, false, inappropriate content or material or content or material which does not comply with local laws or regulations.
      • infringe upon the rights of others.
         
    2. Whenever you make use of a feature that allows you to upload or post content to our site or to make contact with other users of our site, such as commenting, adding reviews, or noticeboard features, you must comply with the following requirements:
      Contributions must:
      • Be accurate (where they state facts).
      • Be genuinely held (where they state opinions).
      • Comply with applicable laws in the UK and in any country from which they are posted.
         
    3. Contributions must not:
      • Contain any material which is defamatory of any person.
      • Contain any material which is obscene, offensive, hateful, or inflammatory.
      • Promote sexually explicit material.
      • Promote violence.
      • Promote discrimination (e.g. based on race, sex, religion, nationality, disability, sexual orientation, or age).
      • Infringe any intellectual property of any other person.
      • Be likely to deceive any person.
      • Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
      • Promote any illegal activity.
      • Be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience, or needless anxiety.
      • Be likely to harass, upset, embarrass, alarm, or annoy any other person.
      • Be used to impersonate any person, or to misrepresent your identity or affiliation with any person.
      • Give the impression that they emanate from us if this is not the case.
      • Advocate, promote, or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.
         
    4. You warrant that any contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty. Any content you upload to our site will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you are required to grant us a limited licence to use, store and copy that content and to distribute and make it available to third parties. We also have the right to disclose your identity to any third party who is claiming that Content posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy. We will not be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other user of our site. We have the right to remove any posting you make on our site if, in our opinion, your post does not comply with the content standards set out above. We may also take any other action we deem appropriate. The views expressed by other users on our site do not represent our views or values.
       
    5. If you violate any of the Terms (including the Code of Conduct), we may have to suspend your account, stop providing Services to you and close your account altogether. We may refuse permission for you to post or upload Content and/or remove your Content for any reason at our sole discretion. We may have to announce to other users on the suspending or closing of your account under such situations if it is appropriate to do so. When investigating an alleged violation of such terms, we reserve the right to review your Content in order to resolve the issue and you hereby authorize such review. 
       
    6. Please note that we cannot monitor every single conversation and piece of Content uploaded or shared via the portal and make no attempt to do so. 
       
  8. Updates to the Services and Changes to These Terms
    1. We may change, amend, and update these Terms at any time and will notify you accordingly if we choose to do so. If you subsequently use our service after any change, amendment, or update of these Terms, you agree to be bound by such terms. If you do not agree with any of the new terms, you must stop using the service. After any update, we do not guarantee such updates will be compatible with your device, you may need to update your device to use our service. 
       
  9. Viruses
    1. We cannot guarantee that our site will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes, and platform in order to access our site. You should use your own virus protection software. You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs, or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored, or any server, computer, or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.
       
  10. License
    1. Subject to you complying with these Terms (and any additional terms you agree or have agreed with us), we grant account holders a license to use their account and use the Services we provide.  We reserve all rights to the Site and Services. 
       
    2. No rights are granted to copy, publish, resell, or redistribute any of the Services of this Site.
       
  11. Intellectual Property Rights
    1. We are the owner or the licensee of all intellectual property rights relating to our site and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
       
    2. You may print off one copy and may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organisation to content posted on our site. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences, or any graphics separately from any accompanying text. Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged. You must not use any part of the content on our site for commercial purposes without obtaining a licence to do so from us or our licensors. If you print off, copy or download any part of our site in breach of these Terms, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
       
  12. Warranties and Liability
    1. We make no warranties, either express or implied, or guarantees or conditions with respect to your use of this Site and Services and accept no liability for any loss arising for errors or omissions or through the application process. You understand that use of this Site and Services is at your own risk. We provide this Site and Services on an “As Is” condition. We strongly recommend users to re-confirm with the relevant schools or organizations that their account and public information is up-to-date states and whether they are a Registered Tier 4 sponsor in the UK. 
       
    2. In the event of an application, the relevant school or its agent or representative shall have the final decision on the result on each applicant. Each applicant should read and understand each school’s rules and terms and conditions before they apply. For the avoidance of doubt, any application is outside of our control; we merely facilitate a platform allowing prospective students/applicants to engage with schools. 
       
    3. Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by the law of England and Wales. To the extent permitted by law, we exclude all conditions, warranties, representations, or other terms, which may apply to our site or any content on it, whether express or implied. We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
      • use of, or inability to use our site; or
      • use of or reliance on any content displayed on our site.
         
    4. If you are a business user, please note that in particular, we will not be liable for:
      • loss of profits, sales, business, or revenue;
      • business interruption;
      • loss of anticipated savings;
      • loss of business opportunity, goodwill, or reputation; or
      • any indirect or consequential loss or damage.
         
    5. If you are a consumer user, please note that we only provide our site for domestic and private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity. We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data, or other proprietary material due to your use of our site or to your downloading of any content on it, or on any website linked to it.
       
  13. Jurisdiction 
    1. The use of this Site and Services, these Terms and its subject matter and its formation are governed by the laws of England and Wales and are subject to the exclusive jurisdiction of the courts of England and Wales.
